Privacy Policy

As Apple Film Co., Ltd. (hereinafter referred to as the “Company”) recognize the importance of the protection of personal data which you have provided or will provide, therefore, the Company has prepared this Personal Data Protection Policy for your understanding and acknowledgement of the procedures of the Company in relation to the collection, use, and disclosure of your personal data subject to the Personal Data Protection Act B.E. 2562 (2019).

(1) Definitions

“Company” means Apple Film Co., Ltd.

“Personal Data” means any information relating to a Person, which enables or may enable the identification of this Person, whether directly or indirectly, but not including the information of a deceased Person.

Personal Data includes, but is not limited to, name, surname, age, gender, nationality, date of birth, national identification number, passport number, taxpayer identification number, address, telephone number, and e-mail address.

“Sensitive Personal Data” means any information relating to a particular person which is sensitive and presents significant risks to the person’s fundamental rights and freedoms, which includes data regarding racial or ethnic origin, political opinions, cults, religious or philosophical beliefs, sexual behavior, criminal records, health data, disabilities, trade union information, genetic data, biometric data, or any data which may affect the Data Subject in the same manner, as prescribed by the Personal Data Protection Committee.

“Data Subject” means a person whose personal data is collected. This term refers to “you” as a customer / supplier in this Policy.

“Person” means a natural person. Any legal entities incorporated under any laws, including but not limited to, companies, associations, foundations, or other organizations, are excluded.

(2) Collection of Personal Data

Company shall collect personal data within the purpose, scope, and lawful and fair methods as is necessary which is defined in the scope of the Company’s objectives.

(3) Purpose of Collecting and Usage of Personal Data

Company shall collect or use personal data for the purposes of activities such as the procurement process, contract execution, financial transactions, company activities, collaborations or improvement of the Company’s processes; database preparation, process analysis and development, and/or any other purposes which are in compliance with the legal obligations or regulations to which the Company are subject.

Company shall retain and use the Personal Data as long as necessary only for the above-mentioned purposes, or as prescribed by laws.

Company shall not conduct any processes which are different from the purposes as have previously been shared with the Data Subject except for when:

  • The Data Subject has been informed of such a new purpose, and prior consent is obtained;
  • It is necessary for Company to be in compliance with this Act or other laws.

(4) Collection of Your Personal Data by the Company

The Company may be required to collect or obtain Personal Data which may enable the identification of a Person, as follows:

  1. Personal data, including but not limited to, titles, name, surname, date of birth, age, national identification number, passport number, taxpayer identification number, nationality, etc.
  2. Contact information, including but not limited to, telephone number, postal address for delivery of goods, billing address, e-mail address, social media account, etc.
  3. Financial information, including but not limited to, debit and/or credit card information.
  4. Sale and purchase of goods and services transaction information, including but not limited to, receipt/refund of money information, date of payment, time of payment, amount of payment, purchase of purchase order number, date/time of receipt or delivery of goods, a Person’s message regarding the acceptance of goods, goods warranty information, complaints and claims, and other information in relation to the purchase of goods and services.
  5. Sensitive data, including but not limited to, data pertaining to race, ethnicity, religion, fingerprints, facial recognition, health data or data related to physical or mental conditions, genetic data, medical history, disability, and criminal records.
    The Company will strictly collect Personal Data only to the extent necessary subject to the purposes specified in this Personal Data Protection Policy.

(5) Personal data disclosure

Company shall not disclose personal data of the Data Subject without the consent of the Data. Subject and shall disclose it solely for the above mentioned purposes. However, for the benefit of company operations and service provision to the Data Subject, Company may disclose personal data to Company’s subsidiaries or other required persons, domestically and internationally, such as service providers dealing with personal data. Company shall govern the above-mentioned persons to treat the personal data as confidential and not to use the data for purposes which are not covered in prior notifications.

  1. With other companies in the group company: We may need to share your personal data with other affiliated or related companies whether in Thailand or foreign countries in order to manage and administer our services including but not limited to sales and marketing.
  2. With our service providers / Business Partner: We may use other companies, agents, contractors to perform services on behalf or to assist with the provision of products and services to you. We may share your Personal Data to our service providers or third-party suppliers such as bank and financial institution; logistic and courier service providers; outsourced administrative service providers; data storage and cloud service providers; insurance company; internet, software, digital media, IT system service providers, and IT support company.
    In the course of providing such services, the service providers may have access to your Personal Data. However, we will only provide our service providers with the information that is necessary for them to perform the services, and we ask them not to use your information for any other purposes. We will ensure the service providers we work with will keep your Personal Data secure as required under the laws.
  3. With Governmental Authorities and Third Parties required by law: Company may disclose personal data of the Data Subject as required by laws and regulations, such as disclosing it to a government agency, state enterprise, regulator. Also, the Company may disclose it by virtue of laws, such as requests for the purposes of litigation or prosecution, or requests made by the private sector or other persons involved in the legal proceedings.
  4. With Professional advisors: This includes legal consultants, auditors or other consultants who assist in running our business, and the defending or bringing of any legal claims.
  5. With Assignee of rights and/or obligations: Third parties as our assignee, in the event of any reorganization, merger, business transfer, whether in whole or in part, will comply with this Privacy Policy to respect your Personal Data.

(5) Personal data disclosure

(6) Transfers of Personal Data outside Thailand

We may disclose or transfer your Personal Data to third parties or servers located overseas, which the destination countries may or may not have the same data protection standards. We take steps and measures to ensure that your Personal Data is securely transferred and that the receiving parties have in place suitable data protection standards or other derogations as allowed by laws.

(7) The Period for which Personal Data will be Retained

We may disclose or transfer your Personal Data to third parties or servers located overseas, which the destination countries may or may not have the same data protection standards. We take steps and measures to ensure that your Personal Data is securely transferred and that the receiving parties have in place suitable data protection standards or other derogations as allowed by laws.

(8) Your Rights as the Data Subject

If the Company collects, uses, or discloses your Personal Data subject to the purposes specified in this Policy, you have the following rights pursuant to the Personal Data Protection Act B.E. 2562 (2019):

  1. The Right to withdraw consent; however, any consent which was obtained earlier shall not be affected.
  2. The right to access; and obtain a copy of your Personal Data which is under the responsibility of the Company.
  3. The Right to data transfer.
  4. The right to object to the collection, use, or disclosure of your Personal Data at any time.
  5. The right to request for the erasure, destruction, or anonymization of your Personal Data.
  6. The right to request for the temporarily restriction of the use of your Personal Data.
  7. The right to request for the Company to make your Personal Data accurate, complete, and up-to-data.

If you wish to exercise the foregoing rights, you are required to make a written statement. The Company will use its best efforts to perform actions in due course and no later than the period prescribed by law. The Company will strictly comply with the laws concerning your rights as the Data Subject.

The exercising of rights to request the erasure, destruction, or anonymization of your Personal Data, temporary restriction of use, or withdrawal of consent may result in the Company being unable to render services to you.

(9) Personal Data Protection Measures

The Company provides appropriate security measures for preventing the unauthorized or unlawful loss, access to, use, alteration, correction, or disclosure of Personal Data, and such measures will be reviewed by the Company when it is necessary, or when the technology has changed in order to efficiently maintain the appropriate security and safety.

(10) Revision of the Personal Data Protection Policy

The Company reserves the rights to revise and amend this Personal Data Protection Policy as deemed necessary and appropriate. Any revision or amendment will be announced and published on the Company’s Website or by any other appropriate method.

This Personal Data Protection Policy is prepared in accordance with the Personal Data Protection Act B.E 2562 (2019) and published in both Thai and English. If there are any discrepancies in terms of meanings or interpretations between the Thai and English versions, the Thai version must prevail.

Given this announcement being effective since May 30, 2022 from now on.
